Waiver and Release of Liability Form

Interpretation

This Waiver and Release of Liability Form is governed by the laws of New South Wales and the Parties submit to the non-exclusive jurisdiction of the courts of that state.

In the interpretation of this Form:

References to legislation or provisions of legislation include changes or re-enactments of the legislation and statutory instruments and regulations issued under the legislation; Words denoting the singular include the plural and vice versa, words denoting individuals or persons include bodies corporate and vice versa, words denoting one gender include all genders, and references to documents or agreements also mean those documents or agreements as changed, novated or replaced;

Grammatical forms of defined words or phrases have corresponding meanings;

Parties must perform their obligations on the dates and times fixed by reference to the capital city of New South Wales;

Reference to an amount of money is a reference to the amount in the lawful currency of the Commonwealth of Australia;

If the day on or by which anything is to be done is a Saturday, a Sunday or a public holiday in the place in which it is to be done, then it must be done on the next business day;

References to a party are intended to bind their executors, administrators and permitted transferees;

and Obligations under this Form affecting more than one party bind them jointly and each of them severally.

Assumption of Risk

I, the undersigned, understand and acknowledge that participating in boxing training and related activities at IQ Academy involves inherent risks and hazards. These risks may include, but are not limited to, physical injury, serious bodily harm, and even death. I voluntarily choose to participate in these activities, fully understanding and accepting the potential dangers associated with them.

Waiver and Release

In consideration of being allowed to participate in boxing training and related activities at IQ Academy, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby waive, release, and discharge IQ Academy, its owners, trainers, employees, agents, and representatives, from any and all claims, demands, actions, or causes of action for any injury, loss, damage, or death arising out of my participation in these activities. 

I understand that this waiver and release includes, but is not limited to, claims based on the negligence or gross negligence of IQ Academy and its representatives. I also understand that IQ Academy does not assume any responsibility for my personal property that may be lost, damaged, or stolen while on the premises.

Medical Fitness

I certify that I am in good physical condition and have no medical conditions, illnesses, or disabilities that would prevent me from safely participating in boxing training and related activities. I acknowledge that it is my responsibility to consult with a physician before starting any new exercise program.

Code of Conduct

I agree to abide by all rules, regulations, and safety guidelines established by IQ Academy and its trainers. I understand that any violation of these rules may result in my immediate removal from the gym without a refund.

Photography and Likeness

I grant IQ Academy the right to use, reproduce, and/or publish photographs, videos, or other likenesses of me for promotional purposes, without compensation.

Entire agreement

This Waiver and Release of Liability Form is the entire agreement and understanding between the Parties on everything connected with the subject matter of this deed, and supersedes any prior understanding, arrangement, representation or agreements between the Parties as to the subject matter contained in this deed.

Further Assurance

Each party will from time to time do all things, including executing all documents, necessary or desirable to give full effect to this Waiver and Release of Liability Form.

Governing Law

This Waiver and Release of Liability Form is governed by the laws of New South Wales. The Parties submit to the nonexclusive jurisdiction of the courts of that state and any court hearing appeals from those courts.

Giving effect to this Document

Each party must do anything (including execute any document) and must ensure that its agents, do anything (including execute any document), that any other party may reasonably require to give full effect to this Waiver and Release of Liability Form.
